EU law professor Kenneth Armstrong says Article 50 could be amended or revoked amid calls for Britain to stay in the European nuclear agency. Euratom is separate from the European Union
(EU), but Theresa May has insisted the UK needs to quit the body because of her “red line” on post-Brexit meddling by the European Court of Justice (ECJ). However Mr Armstrong said the prime
minister’s Article 50 letter has “no binding legal quality”. Writing for the University of Cambridge, he said: “Any attempt to remain in Euratom would beg the question whether the Article
50 letter can be subsequently amended or, indeed, revoked. “In her March ‘Article 50’ letter to European Council President, Donald Tusk, the Prime Minister Theresa May notified the EU of
the UK’s intention to withdraw not just from the treaties establishing the EU, but also from Euratom. “The wording of Article 50 does not tell us whether amendment or revocation is
possible. A European Commission Press Release does state that notification is a ‘point of no return’ and does not provide for ‘unilateral withdrawal of notification’.” Parliament is set to
debate whether the UK should remain in Eurotom on July 12 after concerns a Euroatom exit could have a huge impact on cancer patients. It has been warned they could face delays to treatment
if there are difficulties moving radioactive material around. The Royal College of Radiologists say that leaving Euratom could threaten the supply of vital isotopes and create more delays
for hospital patients.
