Close was hit and killed by a car while working for Altus Traffic on Vermont Road at Mowbray on February 5, 2013.

Venarchie Contracting had hired Altus Traffic for traffic management while Venarchie Contracting employees resealed some of the road.

Mayfield man Murray Higgs was charged and pleaded guilty to causing Mr Close’s death, but the Director of Public Prosecutions has also proceeded against Venarchie Contracting and Altus

Traffic.

Both are charged with one count of failing to comply with a health and safety duty category two.

A category two offence is the second worst of its kind and alleges the companies played a role in Mr Close’s death, but were not the cause.

In the Launceston Magistrates Court on Thursday, Magistrate Sharon Cure concluded a hearing of Venarchie Contracting’s case.

She said she would hand down her decision before the new year.

The almost-week-long hearing heard evidence from employees of both companies who were present on the day.

Most of the men who were present during the incident said their recollections were hazy, and they only saw the aftermath of what had occurred.

The matter will return to court on December 1.

Altus Traffic will also face a hearing next year.
