plastic waste and scrap from M/s Scrap in Carrollton, USA. In a deal signed in 2005, the consignee had promised to ship the consignment to the complainant for which it had approached the
shipping firm. The consignee had asked the firm to send the goods to the Nhava Sheva Port in Mumbai. According to the complainant, it had asked for the consignment to be delivered to ICD
Sachin in Surat, but as the Bill of Lading mentioned the Mumbai port, the consignment was delivered there. After the consignment was delivered, the complainant had requested the firm to
ship it to Surat, but it refused to do so claiming that the required destination was not mentioned when the consignment was released from USA. The complainant then approached the forum. The
forum held that the complainant had no evidence to prove its claim and dismissed the plea. _@plotlikar_
